Major gains for all the main collection sources for Spain’s SGAE
Spanish authors’ society SGAE has published its annual accounts for 2022 after receiving approval from its membership at the May annual general meeting. Total collections increased to the highest level for 15 years and marked the second consecutive year of growth after falling annually since 2018. Live concerts scored the highest growth, with collections more than doubling. Moreover, the income total exceeded the prepandemic level. General licensing also saw an impressive improvement, with receipts from background music rising sharply. Broadcasting remained the biggest collection source as backdated income boosted the total for the second year in a row. Digital revenue was up year-on-year, and there were impressive gains for on-demand audio and video streaming. Distributions to SGAE members greatly improved on the prior year, with further growth expected for 2023.
Canada Federal Court denies Voltage reverse class action copyright infringement claim
Canadian movie producer Voltage Pictures has failed in its latest attempt to have a copyright infringement claim certified as a reverse class action. The movie producer had filed a claim against a landlord whose internet account had been used to share five movies. Voltage had hoped to use the landlord as the representative defendant on behalf of several hundred unidentified internet users that had shared the movies without permission. The movie producer believed that Canada’s notice-and-notice regime could be used to streamline its copyright enforcement efforts and do away with the need to send each infringer a separate notice. However, the Ottawa Federal Court has decided that the Canadian Copyright Act does not allow the regime to be used in that way. Although costs were awarded to the landlord, the court has allowed Voltage to submit a revised claim. While the case centers on the unauthorized distribution of movies, a positive ruling for Voltage could have opened up a new avenue of copyright enforcement in Canada for local music companies.
MLC pays out $1bn but must up its game on unclaimed royalties
The Mechanical Licensing Collective (MLC) was tasked by new US music legislation to deal with the digital music era and ensure that royalties earned translated into royalties paid out. And just a few years after its launch, the collecting society has signed up more than 20,000 rights holder members and surpassed the $1bn payout mark. That’s no small sum. But the MLC has come under fire for the burgeoning size of its unclaimed royalties pool, something that makes it look inefficient in the short run-up to its first-ever review of operations. The organization, whose setup makes its members do a lot of the spadework to get paid, needs to be more proactive in reducing the size of the pool.
Sweden country report
In addition to the usual set of music industry statistics and news briefs, the latest issue of Music & Copyright includes a detailed Sweden music industry report. As home to the world’s biggest on-demand audio subscription service Spotify, Sweden is widely considered to be one of the world’s most progressive recorded-music markets. The country’s digital share of combined physical and digital formats and service trade sales exceeded 94% last year, with both audio and video streaming registering positive gains. After a rise in trade sales of physical formats in 2021, revenue edged down last year. Despite the continued renaissance of vinyl, sales of the age-old format couldn’t quite offset the sharp fall in CDs. Further growth in total recorded-music trade sales is expected over the next five years, although the annual rate of increase is set to slow. UMG maintained its position as the biggest distributor, although SME closed the gap slightly with a rise in market share. STIM registered a second straight year of rising collections, but both SAMI and Copyswede suffered a fall in revenue. All indicators suggest live music has made a welcome recovery. Live collections by STIM grew sharply, and PwC has forecast annual rises in spending on tickets for the next five years.
